This privacy policy related to the services offered by VIVA11 is defined in this document.

Kross Games India Pvt. Ltd. operates the platform in India, which enables users in select States of India (“users” or “you” or “yours”) to access and participate in skill-based online cricket fantasy games through the web-portal VIVA11.com and partner website(s) and mobile application(s) (collectively referred to as the “Platform”) (Kross Games India Pvt. Ltd referred to as “VIVA11” or “we” or “our” or “us”)

POLICY OBJECTIVE

This document explains how VIVA11 collects, processes, stores and/or shares any personal data and/or information from users (jointly referred to as “Information”). By accessing and/or using the Services you consent to the collection, transfer, manipulation, storage, disclosure and other uses of your information as described in this Privacy Policy. If you have any concerns about providing data, or having it used in any manner permitted in this Privacy Policy, you should not use the Services. As set out in the terms and conditions relating to the Services (the “Terms”), you must be at least at the legal age (minimum age of 18 years) to access and/or use the Services.

THE INFORMATION COLLECTED

Information you provide: when you register on the Platform, you will be required to provide us with your name, your location, email address, mobile number, display picture, social media account ID (where submitted by you), and other relevant profile information. Additionally, you will be required to provide your bank account details when you make use of the add cash or cash withdrawal options and your Permanent Account Number (PAN) when you use the cash withdrawal option.

1. Cookies: To improve the responsiveness of the sites for our users, we may use “cookies”, or similar electronic tools to collect information to assign each visitor a unique, random number as a User Identification (User ID) to understand the user’s individual interests using the Identified Computer. 2. Links: VIVA11 may contain links to third party websites or applications. You agree and understand that privacy policies of these websites are not under our control. You understand that once you leave our servers, use of any information you provide shall be governed by the privacy policy of the operator of the site used by you.That policy may differ from VIVA11’s own. VIVA11 is not responsible for the privacy practices or the contents of such third party websites.

Advertising: Advertisers on mobile devices sometimes use advertising identifiers to enable and optimize their advertising, to deliver tailor ads related to your interests (Interest-Based Advertising or IBA). These identifiers are non-permanent, non-personal, device identifiers. 4. Third-party services: The Platform may contain links to third-party websites or services (“External Resource”). Your browsing on and interaction with any External Resource, irrespective of whether the link to such External Resource originated on our Platform, is subject to the terms and privacy policies of such External Resource. We are not responsible for the functionality, privacy, or security measures of any other entity and this Privacy Policy will not govern your use and access of such website or service you are redirected to.

5. Payment information: If you make a purchase in the Services, VIVA11 may collect the billing and financial information necessary to process the charges; and/or do so on behalf of the relevant payment service providers. Purchases of third-party services are subject to the policies applicable to such providers.

6. Log Data: Servers automatically record information created by your use of the Services. This data may include information such as your IP address, browser type, operating system, the referring web page, pages visited, location, your mobile carrier, device and application IDs, search terms, and cookie information. INTERACTION WITH SOCIAL NETWORKS AND/OR PLATFORMS

You may allow the Services to interact with any third party social network and/or platforms and any other networks/platforms which will provide data about you to VIVA11. Since any other applications or websites different than the Services are owned by a third party, you must ensure that you read their terms of service and the applicable privacy policies. You understand that when you allow the Services to interact with any third party social network and/or platform, VIVA11 may share data about you with your contacts and other users of the Services and vice versa. This data may include your name, profile picture, activity status, and information related to your use of the Services. You can change this by adjusting your settings with that third party provider.

VIVA11 has certain links embedded to third party services. Your interaction with such third party platform(s) are governed by their policies, and we urge you to review their policies before you proceed with availing such services via the offerings of VIVA11.

When you register with us, your account is protected by means of a unique password, which is known to or may be accessed only by you. You are responsible for maintaining the secrecy of your unique password and VIVA11 account information, and for controlling access to emails between you and us, at all times. Therefore, you should not provide your password or login credentials to anyone whosoever: breach hereof constitutes a violation of this Privacy Policy and may result in termination of your VIVA11 account in certain cases. If you become aware of or reasonably suspect any breach of security, including compromise of your password, you must notify us immediately.

DATA RETENTION POLICY

VIVA11 shall retain the information provided by the users for such period of time as is required to fulfill the purposes for which such information is collected, as outlined in this Privacy Policy, subject to such longer time periods of retention as may be required under any applicable laws.

USER ACCOUNT AND DATA DELETION

Users are entitled to request VIVA11 to delete their User accounts and their personal information by sending an email with their written request to support@krossgames.in

APPLICABLE LAW AND JURISDICTION

By visiting this Platform, you agree that the laws of the Republic of India without regard to its conflict of laws principles, govern this Privacy Policy and any dispute arising in respect hereof shall be subject to and governed by the dispute resolution process set out in the Terms and Conditions.

POLICY UPDATES

VIVA11 holds all the rights to review, modify or change the privacy policy of the Platform. However, the usage of user information collected by VIVA11 will stay consistent with the policy under which the information was collected, regardless of what the new policy may be. You will promptly notify VIVA11 if there are any changes, updates or modifications.
